General Terms and Conditions of Sale

1. Definitions

The terms and expressions listed below have the meaning indicated, it being understood that terms defined in the singular are also defined in the plural and vice versa.

  • Customer: any subject (natural or legal person) who purchases one or more Products through the Online Store, accepting the General Conditions.
  • HOTEL PALACE GESTIONE SRL: based in Merano at Via Cavour 2/4, registered with the Bolzano Companies Register, Tax Code 01513520211 and REA registration number BZ 126205.
  • Parties: jointly HOTEL PALACE GESTIONE SRL and the Customers.
  • General Conditions: these general terms and conditions of sale and any future new versions that may be published in the Online Store.
  • Online Store: the virtual store, managed by HOTEL PALACE GESTIONE SRL and accessible via URL https://shop.palace.it, through which Products can be purchased.
  • Sales Contracts: the sales contracts for Products concluded between HOTEL PALACE GESTIONE SRL and Customers through the Online Store.
  • Orders: purchase orders for Products sent by Customers, in accordance with the General Conditions.
  • Order Confirmation: the email message through which HOTEL PALACE GESTIONE SRL communicates acceptance of Orders to Customers.
  • Price: the selling price of Products as indicated in the Online Store.
  • Products: the products published in the Online Store for sale.
  • Profile: the area of the Online Store where Customers can view their data, orders and specific functions.

2. Object

2.1 The General Conditions govern all Sales Contracts and form an integral part thereof.

2.2 HOTEL PALACE GESTIONE SRL reserves the right to modify the General Conditions at any time.

2.3 In case of conflict between the General Conditions and any other terms, the terms more favorable to Customers shall apply.

3. Conclusion of Sales Contracts

3.1 HOTEL PALACE GESTIONE SRL undertakes to send Customers the Order Confirmation within 2 business days of receiving Orders.

3.2 Sales Contracts are deemed concluded when Customers receive the Order Confirmation.

3.3 By sending Orders, Customers declare they have fully accepted the General Conditions.

3.4 Orders will be archived in compliance with Privacy regulations.

4. Product Availability

Product availability is indicated in the Online Store. In case of subsequent unavailability, HOTEL PALACE GESTIONE SRL will communicate expected availability times. The Customer may withdraw the Order within 48 hours.

5. Prices

Product Prices are those indicated in the Online Store at the time of Order submission. Prices include VAT.

6. Order Submission Methods

To submit an Order, Customers must follow the procedure indicated in the Online Store, completing the electronic order form.

7. Orders and Payment

The store accepts payments via PayPal, Credit Card and Bank Transfer. All payments will be made to HOTEL PALACE GESTIONE SRL.

PayPal

PayPal allows any business or consumer with an email address to send and receive payments securely.

Credit Card

You can pay using credit cards from VISA, Mastercard, American Express circuits. Payment is made on a secure server (SSL) with 128-bit encryption.

Bank Transfer

Payment can be made by bank transfer. Bank details will be provided at the time of order.

8. Shipping and Delivery

9. Right of Withdrawal

The Customer has the right to withdraw from the Contract within 14 days of Product delivery, without providing any reason. To exercise the right of withdrawal, the Customer must inform HOTEL PALACE GESTIONE SRL of their decision.

10. Warranties

Products sold are covered by the legal guarantee of conformity provided by the Consumer Code.

Return Policy

Products can be returned in case of damage and must be returned within 30 days of delivery with original labels and in original packaging.

Who pays for shipping?

The cost of returning product(s) to our warehouse is borne by the customer. Shipping of new product(s) will be covered by HOTEL PALACE GESTIONE SRL.

Defects or Errors

If there is a defect or error with your product/order, complete the online return process by accessing "My Orders" and clicking "Request a return".

15. Applicable Law

15.1 The General Conditions and Sales Contracts are governed by Italian law.

15.2 For any dispute, the court of Bolzano shall have exclusive jurisdiction.
